The San Francisco Federal court ruled today that Prop 8 is unconstitutional and it even rejected the motion from the Prop 8 proponents to vacate the district court ruling of Chief Judge Vaughn Walker because he was gay and should have gone public about his sexual orientation and recused himself.
The 3 judge panal comprised of Judge Stephen Reinhardt, Judge Michael Hawkins and Judge Randy Smith who incidentally is a mormon.
“Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples.”
No doubt the proponents of Prop 8 would appeal the ruling and while that goes through, the court would be asked to stay this ruling.
But it is a victory no doubt. Thanks to Ted Olson for making this happen.

a) Whether Judge Walker’s ruling should be reversed because of his sexual orientation and for the fact that he is in a long term relationship so his personal interest may have made him biased while ruling Prop8 is unconstitutional.
b) Whats to be done with the video recordings of the trial which was in possession of Judge Walker. Whether they should be ordered to be submitted to the court.
Judge Ware adjourned court by saying that he would be ready with a written ruling within the next 24 hours.
These 24 hours, all we can do is keep our fingers crossed and pray.
