On Wednesday, 26th June, the supreme court of US have declared DOMA (Defense of Marriage Act) unconstitutional and struck down Prop8 in California now repaving the path for all Californian gay couples to walk down the isle. It was surely a wonderful news to wake up to.
12 states currently allow same sex marriage in United States and 37 more to go. Now its just a matter of time. The ruling couldn’t have come at a better time. Just before Pride celebration starts all over the country.
The San Francisco Federal court ruled today that Prop 8 is unconstitutional and it even rejected the motion from the Prop 8 proponents to vacate the district court ruling of Chief Judge Vaughn Walker because he was gay and should have gone public about his sexual orientation and recused himself.
The 3 judge panal comprised of Judge Stephen Reinhardt, Judge Michael Hawkins and Judge Randy Smith who incidentally is a mormon.
“Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples.”
No doubt the proponents of Prop 8 would appeal the ruling and while that goes through, the court would be asked to stay this ruling.
But it is a victory no doubt. Thanks to Ted Olson for making this happen.
